1. These terms
These terms govern your use of the websites at hayami.io and docs.hayami.io, operated by Hayami Ltd (company number NI742645, registered office Ground Floor, Gallery Building, 65-69 Dublin Road, Belfast, BT2 7HG), referred to as "Hayami", "we", or "us". By using the sites you accept these terms.
2. The product is sold through the Azure Marketplace
Hayami DTM is available exclusively through the Microsoft Azure Marketplace. A purchase is made under the Marketplace's purchase process and is governed by the terms attached to the offer: the Microsoft commercial marketplace terms together with the licence terms shown on the offer at the time of purchase. If those terms conflict with these, the sale terms govern the product; these terms govern the websites only.
3. Content and intellectual property
The content of these sites (text, documentation, diagrams, screenshots, and logos) belongs to Hayami Ltd and is protected by copyright and other intellectual property rights. Hayami and Hayami DTM are trademarks of Hayami Ltd. All rights not expressly granted below are reserved.
We grant you a limited, personal, revocable licence to read the content, link to it, and quote reasonable excerpts, for the sole purpose of evaluating, purchasing, and operating Hayami DTM. Nothing on these sites grants any licence to the DTM software itself, which is licensed separately (see section 2).
You may not, without our prior written permission:
- copy, republish, redistribute, or commercially exploit the content, or scrape or bulk-download it by any manual or automated means;
- use the content, in whole or in part, to design, develop, train, or market a product or service that competes with Hayami DTM, including by providing it to an automated system for that purpose; or
- use the content to create a derivative or substantially similar work, or represent any such work as compatible with, endorsed by, or associated with Hayami.
These restrictions are conditions of the licence in this section; using the content outside them is unlicensed and infringes our rights. They do not limit any right you have under applicable law that cannot be excluded by agreement.
4. Documentation is informational
The documentation describes DTM's behaviour as accurately as we can, but it is provided for information: validate configuration and operational decisions in your own environment before relying on them.
5. Acceptable use
Do not attempt to disrupt, probe, or gain unauthorised access to the sites or their infrastructure, and do not use them for anything unlawful.
6. No warranty
The websites are provided "as is" and "as available", without warranty of any kind, to the extent permitted by law.
7. Liability
To the extent permitted by law, we exclude liability for indirect or consequential loss arising from use of the websites, and our total liability arising from the websites is capped at £100. Liability arising from the DTM product is governed by the sale terms in section 2, which govern all liability arising from the product. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
8. Changes
We may update these terms; the version posted here, with its effective date, is the one in force.
9. Governing law
These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland have exclusive jurisdiction over disputes arising from them.
